Sickening... this woman isn't paying for her crime, she is the  same as she was before the baby died.... just  laying in the bed watching TV and eating.... I would throw in a couple of hundred dollars to have her  a cell built.  Just to see her pay.   Maybe they should restrict her food.... EDINBURG, Texas – A nearly half-ton Texas woman charged in the death of her 2-year-old nephew will remain in her house because the county jail lacks a large enough cell or the medical resources, prosecutors said.

A state district judge on Monday agreed not to send Mayra Rosales, who weighs nearly 1,000 pounds, to jail provided she wear a global positioning system tracker until her trial.

Rosales, 27, was indicted last week on capital murder charges in the March 18 death of Eliseo Gonazels Jr. Prosecutors say the toddler was hit at least twice in the head while in the care of the bedridden Rosales.

Sergio Valdez, Rosales' attorney, did not immediately return messages left for him Tuesday.

Prosecutors said the possibility of checking Rosales into a hospital and putting her under 24-hour surveillance was ruled out due to the prohibitive cost, the McAllen Monitor reported.

Hidalgo County Sheriff Lupe Trevino has argued that incarcerating Rosales would be impossible because the county jail does not have a cell large enough to hold her or medical staff equipped to handle her medical needs.

Prosecutors allege 20-year-old Jamie Rosales, Eliseo's mother, left the toddler with his bedridden aunt even though she knew that the woman was incapable of caring for him. She faces one felony count of injury to a child, punishable by life in prison and $10,000 in fines upon conviction.

I can't even find words to describe how I feel about this one.

Take her freakin tortillas, rice and beans away and I am sure she will lose weight.

There is NO WAY they can allow this woman to live as she had before. NO FREAKIN WAY!!

It's aggravating, I agree, Luv.

Thing is, they make a good point that the cost to incarcerate her would be overwhelming. It's not like she's going anywhere. Now, when she's found guilty, they better throw the book at her and put her crass in jail.

IMO, she put herself in the position she is in...healthwise and legal wise.

She should pay the penalty just like anyone else.

I think it is stupid that we can't stick her fatbutt in jail because "of her health". Heck, give her only was is available to all other prisoners.

She chose her be, now she should sleep in it...so to speak.

She should not be allowed the luxury of home!

I can't believe they can't find someplace else for her to serve her time. I mean, they could remove one set of bars between 2 cells and just set her in there. They don't want to mess with her is the bottom line. If they are going to allow her to remain in her house under house arrest they should remove the TV & Computer, they should give her the same food they give inmates in Prison and let her sit there in solitary confinement thinking about what she has done- a little less food won't hurt her and maybe if she has nothing to do, like watch TV it will encourage her to get up and get a little bit of exercise. Excusing this woman because of her size is wrong.

Just HOW fat do you have to be before you can get away with murder. I've been trying to lose weight, but with this kind of fringe benefit, it might behoove me to eat MORE instead of less!!

I know it Voodoo!! I think the firing squad would work. Maybe we could use a cannon to be sure to get penetration!
