Puzzled about LULAC threatened suit

I am a bit puzzled about the lawsuit action being threatened by LULAC against Farmer's Branch. Why would any judge accept the lawsuit when the city has just decided to enforce already existing laws. Aren't judges supposed to interpret the law, not make new laws?
