Texas Patient Wins Landmark Acquittal in Medical Marijuana Case

(Long Island, N.Y.) A Texas patient who uses medical marijuana to treat the
symptoms of HIV won acquittal on marijuana possession charges March 25 based
on a "necessity defense." Though such a defense - which requires the
defendant to establish that an otherwise illegal act was necessary to avoid
imminent harm more serious than the harm prevented by the law he or she
broke - has rarely been successful in Texas, the jury took just 11 minutes
to acquit Tim Stevens, 53. The trial was hotly contested.
Stevens had never been in trouble until Amarillo police arrested him for
possessing less than 4 grams of marijuana. As a result of his HIV infection,
Stevens suffers from nausea and cyclical vomiting syndrome, a condition so
severe that he has required hospitalization and blood transfusions in the
past.

Extensive research has established medical marijuana as an effective
treatment for nausea and vomiting associated with HIV/AIDS and cancer
chemotherapy, uses recently acknowledged by the prestigious American College
of Physicians. Key in establishing Stevens' medical necessity was the
testimony of Dr. Steve Jenison, medical director of the Infectious Diseases
Bureau for the state of New Mexico's Department of Health.

"This case proved to be a testing ground for public attitudes toward medical
marijuana," said attorney Jeff Blackburn, who represented Stevens. "Even in
a very conservative part of a very conservative state, jurors were willing
to listen to the facts about medical marijuana and give Tim a break, and I
hope this case will help to create a trend in Texas."

"The common sense and decency exhibited by this Amarillo jury is typical of
what we see from voters around the country," said Ray Warren, director of
state policies for the Marijuana Policy Project in Washington, D.C., and a
former North Carolina Superior Court judge. "The American public doesn't
want to see seriously ill patients arrested and jailed for simply trying to
stay alive with the help of medical marijuana. It's time for legislators in
Texas and around the country to follow the public's lead and take action to
protect patients, so that no one battling a life-threatening illness has to
live in fear of arrest."

Finally the peoples voices are being heard OVER the fear mongering BS! Is it not strange EVERY poll shows over 80% of the people in this country, HAVE NO PROBLEM with medical marijuana, yet a few self serving biased and bigoted poplitical parasites STILL refuse to accept the will of those the SUPPOSEDLY SERVE!

I hope EVERY Texsan and American takes this in to account when ANYBODY is attempting to get re-elected or elected, TIME TO CLEAN HOUSE " IN BOTH PARTIES "! Time to put an END to nanny government wanting to play doctor, while causing many misery and pain, PERIOD!

If you or your doctor don't want it, DON'T DO IT, but why cause others pain because of what YOU believe?????????? Does MIND YOUR OWN business ring a bell!!!

All 50 states ratified an American flag protection amendment to the Constitution....and 93% of the entire nation supported that amendment.

That didn't pass either, because just ONE U.S. Senator thought his opinion of the Constitutional Right to Freedom of Speech was better than that of the Supreme Court.

Unfortunately, the people waiting in line are no better than the people we'd love to see hit the curb.

While I don't support the general legalization of pot, I DO support any and all legally prescribed medications and anything that will make a sick person better, or at least more comfortable in terminal cases.

Given the medical history in this case, there wasn't much common sense used in going to trial.

Thank God they gave that person the ability to legally get out of pain. I have a friend with AIDS and he uses pot to control some of his symptoms...of course not legally but i wish that he din't have to buy his "medication" on the streets from unscrupulous dealers. There are many people out here that pot will help.

you know. This blog it makes some good points that need to brough to the attention of our Congress and take notice for those that really need this drug rather than have to waste tax payers money going to court to resolve this matter. I really feel for that poor man having to go through this mess. I just hope that there are others out there do not have to go through like that poor man had to go through. He and others will always be in my prayers. Amen

I heard a government official say, "Marijuana doesn't cure anything". He was right. To the best of my knowledge it doesn't CURE anything. I don't believe anybody ever said it could. I have heard them say, "It relieves my pain". I have heard them say it stops the nausia, and vomiting that comes with chemo, and that allows me to eat". I have heard them say, "It stops the severe muscle spasms I have to endure at night when I try to sleep. Spasms so severe I have literaly kicked myself out of bed". This from a man who suffers from MS. No, marijuana doesn't CURE anything, but if does relieve symptoms. Perhaps someone here can tell me what aspirin CURES? Don't say it cures a "fever", because a fever is not a desease to be cured, it is a symptom to be relieved. I pray that none of you ever have to endure the nausia, vomiting, and inability to eat that often comes with chemo. I pray that none of you ever have to endure the muscle spasms that come with MS. I pray that you have access to the best medicine available, that works best for you, without the fear of inprisonment.

Hey, give me something that will temporarly stop the pain, nausia, and vomiting and I'll be your friend for life! No one likes to feel those symptoms. If I was like that in that condition, HOOK ME UP!!! Anything to take my mind off of that... or just pull the plug. Either or.

My question to you is who was the government official that you are basing your input on? Has he have any professional experience in the medical profession? If so lets see. I want to know? You are saying a lot but there are things in what you are saying that leaves one to question you on. If you know so much in this sector. Why is it then that you are not sharing it and you are simply bashing this blog.

A few beers help some people deal with pain. Should we let people drink at work, or drink and drive if they don't overdo it? Drugs are drugs no matter how you slice it, and pot heads are gonna jump at the chance to say they have a medical condition and need their pot. If pot is legalized, god help us.

No phill we shouldn't let them drink, or smoke cannabis at work. As a medicine cannabis will come with this warning, I'm sure. Do not drive, or operate heavy machinery while using this medication. .08 ring a bell? If I am not impaired at this level of alcohol in my system, doesn't matter I get a citation, and a trip to jail. If I am not impaired at .07 I go home. YES we do let people drink and drive. They aren't allowed to drink at work, but who is watching them at lunch time? 2 Martini lunch, ring a bell? We do what we can to keep impaired people from the work place, and our highways. If you would give it some thought, pot heads can't write a perscription, they can only lie to a doctor, it's up to him to weed out the fakers. Please tell me Phill, what do you think will happen if "pot" were legalized? And just what is your understanding of legalize?

I am for the legalization of pot as a DRUG.It would be fine with me if it were prescribed by a doctor and sold by a pharmacy.Of course that isn't what most pot supporters want.They want it like San Francisco where you get a letter for 200 bucks and buy it at a pot store.Relief for patients with certain diseases,fine,but out there they get pot to relieve an everyday headache.

Thanks To One and All,

Much common sense was shown as well as some honest concerns.

First off, this issue IS NOT about those who might abuse pot. Those wanting to use pot ARE! This is about getting your supposed public servants and those who can't mind their own damn business OUT OF your doctors office, and peoples private lives!

How anyone can live with themselves and could justify the misery and harming others for their own fears and biases is beyond REALITY AND REASON! If you don't believe in it, DON'T DO IT, PERIOD! But to force others to suffer simply because one thinks it might be abused, IS BS! IMHO

Brother just so you know, IT IS LEGAL to drink and then drive, IN EVERY STATE "" BY "" LAW!!! Your lack of honesty and or lack of knowledge of the true facts makes one believe you care more about your perceptions and biases than the rights and freedoms of others?

You are correct there are MILLIONS of Americans ( and BILLIONS around the world) that believe that pot laws are BS, and yes I am one! " BUT " that is NOT the issue in this case! To try and manipulate your concerns and fears in to CAUSING AND CONTINUING the misery and pain of others, DOES WHAT GOOD??? If your against free people using the " ALMIGHTIES " gift to all, one that has NEVER in the recorded history of this planet caused a death from simply using it, SO BE IT!

But how do you justify CAUSING others to suffer simply because of YOUR FEARS AND BELIEFS??? Does not everybody have a right to their own beliefs as well, and their beliefs CAUSE YOU NO MISERY OR SUFFERING? 12 states

12 states have let the people vote on this issue, EVERY TIME IT PASSED! Yet your supposed public servants and your government REFUSES to accept or follow the will and votes of those they supposedly serve, FACT! To me that is totally disgusting and repulsive! If they don't agree with those who pay them with their tax dollars and they supposedly serve that is one thing! " BUT " to refuse to obey those they supposedly serve and their VOTES, shows their true colors and EACH should give up or be forced to give their badges and offices, PERIOD!
