I actually have *no problem* with restaurants posting the calories in food items, because it just might make me think a little before I choose.  I don't, however, agree with the  GOVERNMENT making it a regulation.  People ought to be given a little more credit in making their own choices.  Next, hamburgers and fries will be outlawed.  Or maybe anyone who weighs more than 150 pounds won't be able to order certain menu items.  Govrnment regulation is getting ridiculous. Has Hitler been reincarnated?  Seems like pretty soon "America" won't be known for its "freedoms" anymore.  The upside of that might be that illegals will then stay in their own country.

NYC's calories-on-menus law upheld

NEW YORK - A federal judge on Wednesday upheld a city regulation requiring calories to be posted on the menu boards of some chain restaurants, calling the rule a reasonable approach to health officials' goal of reducing obesity.

 The judge turned back a challenge from the New York State Restaurant Association, a voice for the food service industry.

"It seems reasonable to expect that some consumers will use the information disclosed ... to select lower calorie meals ... and these choices will lead to a lower incidence of obesity," U.S. District Judge Richard Holwell said.

New York City's Department of Health and Mental Hygiene believes the regulation, which takes effect Monday, will prevent 130,000 New Yorkers from becoming obese and will stop another 30,000 from developing diabetes over the next five years.

"We just want people to have the information available to them to make healthful decisions," said health department spokeswoman Jessica Scaperotti.

The new rule applies to restaurants in the city that are part of chains with at least 15 outlets across the country. That includes fast-food places like McDonald's and such sit-down chains such as Olive Garden and T.G.I. Friday's.

The city Board of Health voted unanimously in January to approve the regulation, a new version of a rule that had been struck down by a judge last year after a challenge from the restaurant association.

"We don't object to people doing it voluntarily," restaurant association spokesman Chuck Hunt said Wednesday in an interview before the ruling was released. "Our problem was the government agency forcing them to do it. We think restaurants should be able to determine from their customers how they want to get the information."

It was not immediately clear whether the association would appeal.

Some restaurants including Starbucks and Chipotle have already started to post calories on menus. The health department said it will not start fining restaurants until June 3.

New York City, which banned trans-fat-laden cooking oils from all restaurants last year, is believed to be the first U.S. city to enact a regulation requiring calories on menus.

Since then, California lawmakers and those in King County in Washington, which includes Seattle, have considered similar bills.

If those fat butted federal judges would get off theirs and lose some of their flab, maybe they could lead people away from being a walking hog !

Only exercise they do is with their mouths, and I don't wan't to know what goes in there !

Don't let kids play tag, but count their calories - BUMMER !

from the same city that actually banned "trans-fats"........geez it's a wonder you can still GET your hands on a burger up there....mabye not for much longer though.....tofu?.....anyone?

Okay this may sound harsh, but if people are too stupid to realize hamburgers from fast food places are not "healthy"...then maybe them kicking off early due to heart disease isn't such a bad thing.

This of course isn't directed at those people that like fast food, but actually do know it isn't healthy. Just the idiots that don't know any better.

I am actually pretty good at making unhealthy food at home as well as getting it from fast food places. My argument is that government is trying to control the food industry, just as they have done with smoking and other issues in the past. Soon they will be telling us where, when, and what we can eat, what time to go to bed, when we can go fishing, etc etc.

Its not just fast-foods. What about the candy and soda machine ban hysteria? I guess they didn't take into account that account that some of these kids get home and go straight for the 12 pack of mountain dew and ding dongs in the pantry. The McDonald's and the school cafeteria aren't the only people can pack on extra weight. Just walk to your fidge.

BTW, there's a place on Carrier and Freetown in grand prairie called Simones. You like a good burger? MAN! A hamburger, steak fries and a canned drink for $3.99. Best burger since the 70's.

I like fidge better, justin. lol. I have never been able to figure out what went wrong from when I was growing up and now. I suppose some of it has to do with the processed foods, some due to families having no time for sit down meals, therefore the need to grab and go, AND, people on food stamps or with low income can't afford the fruits and veggies or meat, so settle for bread and donuts and soda.

Also, even today, when they say a serving of steak is 4 ounces (that the size of a card deck), how many of us have double that, WITH a loaded baked potato and a salad with dressing, and maybe some garlic toast. That which I just mentioned is an entire days worth of calories......STILL, I don't want someone telling me what I can and cannot have (even if they are right, to a degree).

Pssst, Jakks, or Jakes (or Kellers) has some YUMMMYYY burgers too (Thankfully I am not a french fry person).

This is the reason I love the burgers at Dairyette on Ferguson @ Oates. They fry their burgers on a NO CALORIE grill and fry their french fries in a NO CALORIE hot fryer. ha ha. Grease running down your arms. That and the nostalgia of all the old 'rods. Can't be beat.

can you get me the exact address of that no-calorie dining rusty? The way I have it figured, if I eat all my meals at the no calorie place, I can lose 90 pounds a month! :)) (140 pounds if I combine exercise with it)

Guys, just start losing weight ok? I totally agree with the governments decision to post the calorie count of food at fast food chains. We have to make wise choices for the sake of our health. No intrusion on individual rights here, but to help you wise choices.

Americans are obese, that is a fact and NOTHING to be proud of. Fat is fat and it is unhealthy.

Your comment is welcome here, but I still disagree. Is the government going to decide what we eat at each meal? I can see it now

Breakfast:
1/2 grapefruit
1 slice DRY low cal toast

snack:
1/2 can of green beans

lunch:
3 ounces of tuna
4 lettuce leaves
1 tsp low fat mayonaise
1 pkg cup of soup (chicken noodle, 45 calories)
2 large strawberries

snack:
tea

dinner:

4 oz. steak (broiled, lean cut)
4 carrots
2 cucumbers
1 pkg cup o soup (chicken noodle, 45 cals)
1 TBLSP. low calorie, low fat ranch dressing
1/2 cup tomato juice

snack:

one cup air popped popcorn, with Molly Mcbutter sprinkles.


And if someone wants to eat and die of a heart attack, or smoke and die of lung cancer, that's fine with me. I am pro-choice for pretty much everything!!

Sure, but if more than half of the population of this country can keel over and die anytime because of diet related illnesses/diseases, then something needs to be done about it. Correct?

Either control it now or I say just jack up the prices to the point that we cannot afford a simple hamburger anymore, then maybe we will all start to reflect on this whole thing.

In Europe, a can of coca cola is $12.00. Ahm, see any obese people out there over the pond? Yes there are, but they are NOT the majority of the population.

oh, and about the price of coke being $12.00 in Europe, a carton of cigs in Texas is near 40 bucks (for the same reasons, I surmise). So, I order OUT of state, no tax, and a carton of cigs for 20 bucks. THere is always more than one way to skin a cat. :)

I did get your point, ty tex. The purpose of a blog is to elicit opinions, and I definately got yours, as you got mine.
I don't think its HEALTHY to eat that crap all the time, just saying that people should be free to make their own choices, and not have it mandated. Have a great evening....going to watch American Idol and see who gets voted off.....my hope is that Christy Lee Cook gets voted off.....BETTER not be Jason!! (could be Brooke though....hmm...nother day, nother blog)

I would like to see the corn subsidies that keep corn syrup low as a sweetener be overturned. It used to be that when we had sugar as a sweetener, we maybe got cavities, but not fat. Corn syrup metabolizes differently and some doctors think that it is the cause of much of our national obesity. And it is in everything.

Originally from "way up North", I moved to Dallas about 2 1/2 years ago. I have discovered that where I am from and Dallas are completely different in regards to values, work ethics, and general way of life. That's all I will say for now, as to not *piss off* the masses! Perhaps I will get to that in a blog eventually, or, perhaps not. Oh, and as you'll see, I usually have an opinion on everything...............
