HOUSTON — A prospective juror in a marijuana possession trial was hauled off to jail Tuesday after police said they caught her smoking a joint outside the courthouse.

Attornies in the case had narrowed the jury pool down to 20 people when they took a 45 minute break.

When the break was over, 49-year-old Cornelia Turner Mayo didn't return to Judge Sherman Ross' courtroom.

Turns out she was on a smoking break -- but what she was allegedly smoking was illegal.

"I've had prospective jurors get lost before, but it never occurred to me that they might be getting ready for a marijuana trial by, allegedly, smoking marijuana," Judge Ross told the Houston Chronicle.

Mayo was booked on a charge of possession of marijuana. She'll be arraigned next week in the courtroom across from Judge Ross.

Mayo was released from jail after posting bail.

We're guessing she's not going to be picked for the jury.

Nancy:

I work in the In-Take Section of a County jail. One of my duties includes searching individuals who are being brought into the jail.

Not too long ago, I was searching an individual who had been brought to jail as a result of having been found guilty of possession of marijuana at his trial. While searching the person, I found a plastic baggie, partially filled with marijuana, in the person's pants pocket. I gave the marijuana to the Transporting Deputy, who completed the paperwork to file another possession of marijuana charge against the individual.

I later asked the individual if he would tell me why he took the marijuana with him to court. The person told me that he believed that he was going to be found not guilty and allowed to leave. He said he was going to celebrate by smoking some marijuana. He said that when he was taken into custody by the Court's bailiff, he wasn't able to get rid of the marijuana.

We call this type of person Job Security.

Yes, there is a separate charge for attempting to bring marijuana into a correctional facility. However, when a person is under arrest and being brought into the facility by law enforcement personnel, it is difficult to show that the person was voluntarily bringing the marijuana into the facility. At least, that is the opinion of our District Attorney.

Yeah, but bringing it in would be you knew you were doing and should'a gave it up before you got to lockup.. That's just stupid. lol

Every time I get picked for jury duty for a DUI case, I bring a six pack of coors light in with me. And, I never have to stay for jury duty!! (KIDDING!!!!)
