PHOENIX — Illegal immigrants in Arizona, frustrated with a flagging economy and tough new legislation cracking down on their employers, are returning to their home countries or trying their luck in other states.

For months, immigrants have taken a wait-and-see attitude toward the state's new employer-sanctions law, which takes effect Jan. 1. The voter-approved legislation is an attempt to lessen the economic incentive for illegal immigrants in Arizona, the busiest crossing point along the U.S.-Mexico border.

And by all appearances, it's starting to work.

"People are calling me telling me about their friend, their cousin, their neighbors — they're moving back to Mexico," said Magdalena Schwartz, an immigrant-rights activist and pastor at a Mesa church. "They don't want to live in fear, in terror."

Martin Herrera, a 40-year-old illegal immigrant and masonry worker who lives in Camp Verde, 70 miles north of Phoenix, said he is planning to return to Mexico as soon as he ties up loose ends after living here for four years.

"I don't want to live here because of the new law and the oppressive environment," he said. "I'll be better in my country."

He called the employer-sanctions law "absurd."

"Everybody here, legally or illegally, we are part of a motor that makes this country run," Herrera said. "Once we leave, the motor is going to start to slow down."

There's no way to know how many illegal immigrants are leaving Arizona, especially now with many returning home for normal holidays visits. But economists, immigration lawyers and people who work in the immigrant community agree it's happening.

State Rep. Russell Pearce of Mesa, the author of the employer sanctions law, said his intent was to drive illegal immigrants out of Arizona.

"I'm hoping they will self-deport," Pearce said. "They broke the law. They're criminals."

Under the employer sanctions law, businesses found to have knowingly hired illegal workers will be subject to sanctions from probation to a 10-day suspension of their business licenses. A second violation would bring permanent revocation of the license.

Nancy-Jo Merritt, an immigration lawyer who primarily represents employers, said her clients already have started to fire workers who can't prove they are in the country legally.

"Workers are being fired, of course," she said. "Nobody wants to find out later on that they've got somebody working for them who's not here legally."

When immigrants don't have jobs, they don't stick around, said Dawn McLaren, a research economist at Arizona State University who specializes in illegal immigration.

She said the flagging economy, particularly in the construction industry, also is contributing to an immigrant exodus.

"As the jobs dwindle and the environment becomes more unpleasant in more ways than one, you then decide what to do, and perhaps leaving looks like a good idea," she said. "And certainly that creates a problem, because as people leave, they take the jobs they created with them."

Pearce disagreed that the Arizona economy will suffer after illegal immigrants leave, saying there will be less crime, lower taxes, less congestion, smaller classroom sizes and shorter lines in emergency rooms.

"We have a free market. It'll adjust," he said. "Americans will be much better off."

He said he's not surprised illegal immigrants are leaving the state and predicts that more will go once the employer-sanctions law takes effect next month.

"It's attrition by enforcement," he said. "As you make this an unfriendly state for lawbreakers, I'm hoping they will pick up and leave."

Now the other 49 states need to adopt similar laws. This is the first step in the right direction.

These "immigrants" are breaking federal law. It's pure and simple.
You can "manufacture" an argument if you like by twisting words and personal definitions, but the FACT remains. These "illegal" immigrants are lawbreakers. They have arrived on US soil in an "illegal manor. They must to be deported if we are to remain a law abiding society.

Allow anyone to enter our country any time that they want?
Change the language of this country to whatever suits the latest wave of illegal immigration?
What if that wave became a wave of Al-Qaeda?

I demand RESPECT and RIGHTS for EVERYONE including Americans!

Again it's all about priority. Someone coming here to make a better life for their family SHOULD NOT be treated like a criminal! If they are a WORKING, PRODUCTIVE member of society, they deserve AMNESTY. If they are a CRIMINAL, KICK THEIR @$$ OUT!!

Shutting down the border, building a wall and deporting "fruit pickers" trying to make a better life for their family are NOT good solutions.

Okay, we can twist the words, then, Gorbash. "Human beings who enter our country ILLEGALLY." That is what "illegal immigrant" really means, anyhow.

Polarbear - we are not holding anything against immigrants who enter our country legally or trying to keep them from making a better life. However, laws are laws and anyone who breaks them are criminals. We have laws against people entering our country without the proper channels.

I certainly have no problem with someone who comes over, applies for the proper credentials, and works toward a better life. I do, however, have an issue with those who come here, take away from Americans AND legal immigrants by not following standard procedure to be here.

Latin America is the most Catholic parts of the world. These are people who are coming here to work in agriculture and pick strawberries and oranges to make a better life for their families.

I think that the real solution is that we reform the process of becoming an visitor worker and eventually a citizen.

We should make it cheaper and less expensive and time consuming to become a citizen.

I believe that the only thing that should be required to become a citizen is to have a simple background check, a medical exam to check for communicable diseases, and a class/test on the Constitution and American history.

I also believe that yes, coming here by not going through the proper channels is a crime, but it is a petty crime- similar to jaywalking, or driving without insurance or a license.

They should pay a fine, maybe do a month or two of community service. So yes, they should be punished for breaking the law, but the laws they broke are not as serious as Conservatives make them out to be.

Yup, Ok with that. After we stop the current flow of people doing it the wrong way.

There is room for discussion on that...OK.

I think there needs to be more than that, but that's a start. The test in English?....

Here is where we differ. I understand your argument when it comes to the strawberry pickers, but not everyone is coming here illegally for the reasons you state. There is a lot of organized crime, gang activities and lord knows what else waltzing across our border every day. We need to stop the flow entirely.
If a person comes here in an illegal manor, they should be deported. If they want to come back the right way, start working towards that. However those coming here to traffic drugs, participate in gang activities, etc should be prosecuted and treated like the criminals they are.

Arizona has taken the first step towards sanity in this. I hope other states follow in kind.

They operate all over the world and if you care to minimize their potential impact on us all you have to do is remember back a little over six years ago. I didn't take an army of them to take thousands of innocent lives.
I don't know about you, but I wouldn't leave my back door wide open for even a handful of those zealots.

I know you are well read, but if you want an update on them. It's a eye opener.

oh come on now gorbash, shouldn't an immigrant, who supposedly WANTS to be an american at least have a basic working knowledge of OUR language?

sheesh, even I have a basic, working knowledge of spanish and I still remember it from high school over many many years ago (not aging myself again!)

i believe THAT should be a requirement (and i think that it IS) basic language, AMERICAN history & civics.

Deportation is expensive and time consuming. It creates an excessive stress on poor families who can barely get by as is. These people are leaving to escape poverty, and deporting them will seperate families, harm agriculture and the food supply, and create chaos in their home countries, as well as lead to starvation of the deported families.

The best solution is to make them pay a small fine (500-1000) do some community service, and have them attend public education/classes on American history and the Constitution. This will keep families together and not harm agriculture.

Of course dangerous criminals should be arrested, such as organized criminals and gangs. But the majority of these people simply want to work.
