In preparation for news stories tonight and tomorrow, the news department handed me a copy of the Farmers Branch city council agenda for Monday night. The following item is listed for discussion in the executive session.

"E.2 Discuss pending and contemplated litigation - Texas Government Code Section 55.071 (1): Consult with city attorney on proposed ordinances, resolutions, policies and other issues related to English language proclamation, illegal immigration, business licensing and rental licensing."

According to Texas law, the city council members are allowed to discuss this issue behind closed doors to get legal advice from the city attorney. However, if you were the attorney or if you were allowed into that discussion, what would you say?

What kind of advice would you give the Farmers Branch council members on possibly being the first Texas city to approve an ordinance that is against illegal immigration?

Would this sort of ordinance make the town racist as some Hispanic groups argue?

I have a blog on "Irving - A Safe Haven For Illegals" (Nov. 10). Irving is really going down the toilet. High crime rate, horrible traffic, litter & trash thrown out everywhere. When you go into almost any business, store, or restaurant you will not find any one who speaks English, or if you do, you won't be able to understand them. I can speak basic Spanish so I can get by.

For Farmers Branch, I don't think they will pass any kind of legislation against the illegals. But next year when they have the elections, some of the present councilmen may find themselves not getting re-elected.

Another big question: If FB does pass ordinances against apartment managers or business owners not doing business with illegals, who is going to enforce them?

Anti-illegal, yes. Racist, no. With nothing about to get done in congress on border security, I think we will see more of this type of of localized enforcement. It remains to be seen if there can be any legal enforcement to the localized laws. Immigration is, after all, a federal duty.

I agree with you Marks, immigration is a national issue. But don't think much of anything will be done about it. The Democrats will now work with Bush to establish an amnesty program with some kind of guest worker program. The border fence that they are building will have very little effect on the illegals. They say there are about 33 millions Latinos in the U.S. now (with about 12 million of them illegal). That number is projected to rise to 100 million by the year 2050. In Irving, the mayor has openly declared the city to be a safe haven for illegals, and the police chief has refused to allow the police officers to get involved in any immigration issues.

If FB can get a fair shake from news medias such as Fox 4 who leans far left. Then they my have a chance to run their city they way they see fit. Every city, police and government agency should be racist against illegals. They are breaking the law! They hurt the cities, the state and the government. They put the American economy and jobs in jeopardy. Illegals have no right as long as they are here breaking the law. It’s time that the left wing news stations like Fox 4 and others, plus their reports get that in their weak little minds.

Showdog, I really empathize with you all in Irving.. The Mayor is not using his authorities wisely, it is unfair to the taxpayers in your community. He should not be re-elected.

This is just a non-issue. Somebody has to be first; it might as well be Farmer's Branch.

It's my opinion that Farmer's Branch - like many other "local" communities - is so totally frustrated by the inaction at the State and Federal level (especially the Feds) that they attempting to tackle and resolve the problem(s) themselves. And you can't blame them. The Federal government has been just putrid in running away from this issue. Too many people worried about getting reeclected and not enough people dealing with the Nation's business.

If cities would enact tighter housing codes, this wouldn't happen. Single family homes and apartment should only house single families. Not two families, not ten men, not three women and nine kids-one family. And landlords who don't follow this law should be severely fined and brought back to reality. What sometimes happens is this (and I saw exactly this happen in my own Carrollton neighborhood). A house goes for sale. An absentee landlord buys it as an investment and sets it up with a realtor to manage. A contractor or agent leases the property then illegally subleases it to other parties. The cities and citizens have rights to have their property values maintained. This means that houses and complexes should be in good repair, should be painted to fit the neighborhood, should be free of crime or the owners MUST take steps to make sure that it isn't an attractive nuisance. In our case the house (ours formerly) was bought by one family, who turned it over to a relative. The carefully tended shrubs were mowed down, the large live oak was cut down, the garage was illegally enclosed without abiding by local zoning or code restrictions. A porch was made of plywood held up by two by fours. It housed enough people to have six cars in front of a three bedroon F&J house from the early 80's. Our former neighbors were livid. Then strangers started showing up on the street at all hours of the day or night. Beer cans littered the yard and street. Broken bikes and trashed cars were in the back yard. Then the neighbors went in person to complain and things quieted down for awhile. Then

....And, playing the race card is the sign of desperation. Almost a last resort. Race has absolutely nothing to do with it. Legal vs Illegal has everything to do with it. Personally, I'd feel just as angry about the law NOT being enforced if it was a European country's people breaking it!

Either enforce the law or eliminate it. Ignoring it is a dereliction of duty.

It is incumbent upon every concerned American to write there Representative over this very vital issue several times amonth if Necessary, show them your concern, you write about it enough here take some time to write your Representative.

Hispanic groups are going to call you racist regardless of what you do.

I just hope FB goes through with the plan they are trying to get passed.

Maybe it will act like a pilot program and if it works other cities can follow.

Something needs to be done because it is certainly not going to get better.

Getting it enforced will be a problem.

Hi Tracy,

I am just wondering, if FB does pass some kind of ordinance about immigration, how is it going to be enforced?
My understanding is that they are considering three things,
1. Official language to do business with the government - English only,
2. Landlords cannot rent to illegals,
3. Businesses cannot hire illegals.
How are they going to enforce these if they pass?

I don't think any of these will pass the council. I think they will have to wait till next year and then vote out the councilmen whom they don't like.

"Unlocking the Potential of Farmers Branch" and providing the road map for "other" cities to follow.
Alowing "LULAC" to railrooad over the citizens of Farmers Branch..

I am kind of curious why the LULAC reps are telling the people of FB what to do. Surely we still retain the right of free speech. I may not like what someone says, but they have the right to say it. But according to LULAC, we don't have the right to say, think or do anything that opposes their ideals. Perhaps they haven't read the constitution, but we do still have those rights and frankly the outsiders stirring the pot are making this worse by causing more publicity to fester against their cause. If it's legal, it will pass, if not, it won't. If they don't like the law, then vote the guys out. Ah, but if you are here illegally and can't vote, that's just too stinking bad.
