Tough question Willie!

I would argue that drug testing has nothing to do with the 4th Amendment. My reasoning is simple: If you are being screened for drugs, then you are either in the process of obtaining something (going to public school for an education) or have volunteered for something (US Olympic Team, US Armed Forces).

For employees in the private sector, if you don’t want to be tested, you do not have to work for that company.

You NAILED IT!!!:) How is it NOBODY can see these little steps towards the END OF OUR FREEDOMS??? They " ALWAYS " start out for the protection of us and our young, then they REALLY DO WHAT THEY WANT!!!:(:(

Brother I am one of those stupid people who still believe we are FREE! And will NEVER shame and disgrace those before us, PERIOD!!!

Cowards who sacrifice the freedoms of their children WAS NOT what those before us sacrificed for, FACT!!!

STAND UP AMERICAN, those coming behind us and those who sacrificed BEFORE US, DESERVE AND DEMAND IT!!! They were not cowards hiding in the dark, waiting for our PUBLIC SERVANTS to handle the problems!!!

Marks, then WHY does the Congress cite the fourth amendment as their reason to not be drug tested saying it would violate their rights?

I go with marks on this one. Drugging up is illegal and until that's changed (and I doubt it ever will be) you have to be willing to be tested.
If you don't like getting a ticket for speeding, don't speed.

I have seen where many companies say they drug test for safety reasons. i think as an employer of the Congress they should all be tested because they are responsible for laws that affect the safety of all of us. How do we know that they are not in an alcohol or drug induced stupor? The way they act half the time I have reasonable doubts about them.

Oh! I'm sorry for not understanding the question, willie. Congress should be drug tested. In fact, (I love FACTs Rusty), Congress should be subject to the UCMJ and not the Constitution. The UCMJ is good enough for the military, it should be used for Congress.

Now correct me if it has changed, but I thought the testing was for athletes, etc and not just every student. Every child has a right to an education but NOT to extra- curricular activites, those are a privilage. Therefore, they have an option not to partake. The forth ammendmeant deals with everyday rights such as your house (which is a "need" not a "want" like sports). If kids don't want to be drug tested, then they don't go out for sports...simple enough.

P.S. Kids rights are seriously hindered, they DO NOT have the same rights as adults because they also don't have the same responsiblities as adults.

P.P.S. I am completely on board with drug testing of congress!

When was the last time ANY political parasite AT ANY LEVL WAS TESTED? When was the last time ANY where searched, much less without notice? How is it NEVER has a Narc K-9 been ran throught the offices in Dallas, Fort Worth, Austin or Washington DC?

Drug testing for emploment is a SHAM! Reason being there is NOT a UA that can tell if anyone is under the influnce or when a person last used anything, there is a FACT for you Mark.:) Therefore ones ability to feed their family is on the condition YOU SUBJUGATE your freedoms and let them dictate what you do in life and when one is off the clock and they are not paying you!:( "" UNLESS " you are a HARD DRUG USER! Then in 72 hours you can do a UA for Anybody! But if you use a " GOD " given plant that has NEVER killed anybody, it can be detected up to 90 days! So the least harmful and most used by MILLIONS, denys one the right to feed their family??? Now if we can teach our kids it is ok to be violated without cause, then when they have kids the government can do as they wish with them! Some people actually believe our freedoms are at the mercy of government, BS!

Sadly once again things with hidden agendas were slid in under the guise of safety. And like today the same thing is happening with our young under the guise of protecting our young!!

Time and time again employers and Insurance companies escape liability and accountability by using a UA, FACT! There are cases where people who have been injured on the job THROUGH NO FALT of their own actions. But due to a REQUIRED UA at the clinic or hospital it shows SOMETIME in their past they did pot, FACT! They don't have to PROVE anybody was under the influence, just that they once did it! AND THAT IS PURE BSSSSSSSS! It sickens me to see our people turning in to such cowards, to the point some believe it is acceptable for an employer to own you 24/7! If they can dictate what you do, why is it they don't have to pay you 24/7?? Didn't slavery go out 200 years ago??

But it is ok to force others to conform to the beliefs of others, if you want to feed your family, RIGHT??? But hey, you still have the freedoms our ancestors sacrificed for, if you can support yourself!!:( I guess if one can home school or afford to put your kids in a private school where drug testing IS NOT FORCED without cause, you can still teach them to believe in and to demand their freedoms!!!:(

Sadly once again you can have as much justice, freedoms and liberties as you can afford! See those with means who don't work for a living DON'T HAVE TO SUJUGATE THEMSELVES OR THEIR YOUNG TO THE SAME BS RULES!ONLY THOSE WHO WORK FOR A LIVING???:(

When was the last time EVERYBODY including the OWNERS of these companies and all those in the Insurance companies WERE TESTED UN-ANNOUCENED???

Fourth Amendment – Protection from "unreasonable search and seizure".


"The right of the people to be secure in their persons....."

I do NOT do any drugs and I do NOT drink. I should NOT have to 'prove my innocence' for no reason. It is "unreasonable" to force me to be tested or lose my job. It is a VIOLATION of my rights to "be secure in my person".
If you feel that 'Well, if you don't have anything to hide, it shouldn't matter' then you are missing the point. Why not just implant a chip that will monitor how much alcohol, drugs, fat,sugar, etc. that you consume and ticket you accordingly? How would you feel if everytime you opened your door to go to work you had a policeman there who hauled you off to jail to be tested?
Not for any reason, except that he could?
That is why Congress says it would violate their rights and that is why it violates EVERYONES rights.

MOst companies will have you sign a form saying you will be randonly tested. It is not a violation of the 4th right.

If your loved one was in the hopital and was on may IV drips of medications that were keeping them alive, would you want someone "high" calculating those drug doses? I would hope not. Some professions need drug testing or they could kill someone.

If you are in the hospital you have NO guarantee that the person administering your drugs is not high. Drug abuse is everywhere.
Instead of subjecting me to a random test why not STOP all the gazillion Tons of drugs that you know for a FACT are pouring across our borders?

They attempt to force you to sign away your rights, because if you don't you don't have a job! That is SAD!

Those in hospitals have access to ALL KINDS of legal drugs, why would they need illegal ones?

Taking action against all for the ignorance of a few, WITHOUT PROBABLE CAUSE "" IS "" UN-AMERICAN, PERIOD!
